Please support the artists and their work, attend screenings and events, and otherwise become active in our esoteric little world!<\/em><\/p>\n<p style=\"text-align: center;\">~~~~~<\/p>\n<p style=\"text-align: left;\"><strong>MFHQ &amp; YOU:<\/strong><br \/>\n<strong> Gonna Wash that SOPA Right Outta Our Hair?<\/strong><\/p>\n<p style=\"text-align: left;\">Can you say \u201cmedia-making maelstr\u00f6m,\u201d dearest readers?<\/p>\n<p style=\"text-align: left;\">On Thursday morning, the <strong>Eastman-Kodak Company<\/strong> put long-held rumors to rest as they filed for bankruptcy protection. <a title=\"Eastman-Kodak announces bankruptcy filing :: Reuters\" href=\"http:\/\/www.reuters.com\/article\/2012\/01\/19\/us-kodak-idUSTRE80I08G20120119\" target=\"_blank\"><strong>Reuters<\/strong> outlines the storied history and slow erosion of Kodak\u2019s empire<\/a>, partly due to the <strong>Rochester, NY<\/strong>, firm holding fast to its traditional still and motion picture business and not capitalizing on the digital photography revolution it pioneered, while <a title=\"Kodak Chapter 11 Reorganization :: Home Page\" href=\"http:\/\/www.kodaktransforms.com\/\" target=\"_blank\">Kodak has gone live with a Web site explaining their reorganization plans<\/a>. But wait, there\u2019s <em>more<\/em>, given that experts in archiving \u2013 including the <strong>University of Illinois\u2019 <a title=\"Projects directory :: LIS.Illinois.edu\" href=\"http:\/\/www.lis.illinois.edu\/research\/projects\" target=\"_blank\">Graduate School of Library Information and Science<\/a><\/strong> \u2013 have gone on record to say film stock is the most stable storage solution <em>if<\/em> cared for properly.<\/p>\n<p style=\"text-align: left;\">A day earlier on Wednesday, <a title=\"AMPAS cautions indie filmmakers about taking digital assets seriously :: Variety\" href=\"http:\/\/www.variety.com\/article\/VR1118048861\" target=\"_blank\"><strong><span style=\"text-decoration: underline;\">Variety<\/span><\/strong> posted an announcement from the <strong>Academy of Motion Picture Arts and Sciences<\/strong><\/a> regarding the release of <strong><span style=\"text-decoration: underline;\">The Digital Dilemma 2<\/span><\/strong>, a 136-page report warning the producers and distributors of independent films and documentaries that digital production cannot be archived and retrieved securely for the long term using technology available to them. <a title=\"The Digital Dilemma 2 download :: Oscars.org\" href=\"http:\/\/www.oscars.org\/science-technology\/council\/projects\/digitaldilemma2\/index.html\" target=\"_blank\">The Academy offers this<\/a> and the <a title=\"The Digital Dilemma download :: Oscars.org\" href=\"http:\/\/www.oscars.org\/science-technology\/council\/projects\/digitaldilemma\/index.html\" target=\"_blank\">original 2007 report<\/a>, focusing on asset preservation for the industry at large, as free downloads with an e-mail log-in. So, if indies can barely scratch out the budget to make movies, <em>then<\/em> barely scratch out the budget to promote said movies, <em>then<\/em> barely make any money on said movies from self- or contracted distribution, they\u2019re ultimately screwed farther down the line unless manufacturers introduce affordable and infallible gear that has yet to exist. <em>What?<\/em><\/p>\n<p style=\"text-align: left;\">Also on Thursday, the <strong>United States Supreme Court<\/strong> upheld a 1994 ruling that complies with the <strong>Berne Convention<\/strong> treaty of 1886, restoring copyright to \u201cmillions\u201d of works imported to America from other countries and removing them from public domain status. In effect, this bars any entity \u2013 including academic and community-based \u2013 from using said works in part or whole unless they offer compensation to overseas rights holders. <a title=\"Supreme Court upholds copyrights for foreign works :: The Wall Street Journal\" href=\"http:\/\/online.wsj.com\/article\/SB10001424052970204555904577168752017626174.html\" target=\"_blank\"><strong><span style=\"text-decoration: underline;\">The Wall Street Journal<\/span><\/strong>\u2019s analysis<\/a> implies the gesture is a \u201cgood faith\u201d grab to ensure American works are, in theory, treated with the same fidelity across the world, while the <a title=\"Supreme Court upholds copyrights for foreign works :: The New York Times\" href=\"http:\/\/www.nytimes.com\/2012\/01\/19\/business\/public-domain-works-can-be-copyrighted-anew-justices-rule.html\" target=\"_blank\"><strong><span style=\"text-decoration: underline;\">New York Times<\/span><\/strong> touches on different views<\/a> of copyright and \u201cthe dissemination of existing and future works.\u201d This may force distributors relying on non-American PD material to purge their catalogues simply because they can\u2019t afford the fees or the fuss.<\/p>\n<p style=\"text-align: left;\">Of course, the most publicized media issue last week involved bills that might have given government the power to disable Internet access for sites allegedly posting or selling media properties illegally. <a title=\"Why SOPA is a Bad Idea (video) :: TED\" href=\"http:\/\/www.ted.com\/talks\/defend_our_freedom_to_share_or_why_sopa_is_a_bad_idea.html\" target=\"_blank\"><strong>TED<\/strong> speaker <strong>Clay Shirky<\/strong> of <strong>New York University<\/strong> provides a succinct explanation<\/a> on why media industries wanted the <strong>House<\/strong>\u2019s <strong>Stop Online Piracy Act<\/strong> (SOPA) and <strong>Senate<\/strong>\u2019s <strong>Project IP Act<\/strong> (PIPA) to pass and dampen how American citizens share and create, <strong>Fair Use Act<\/strong> or no. Lead SOPA sponsor <strong>Lamar Smith<\/strong>, a <strong>Texas<\/strong> Republican and <strong>House Judiciary Committee<\/strong> chairman, withdrew it from the table on Friday while the Senate postponed PIPA voting the same day, due to an exodus of political support after Wednesday\u2019s on-line blackout protest led by <span style=\"text-decoration: underline;\"><strong>Wikipedia<\/strong><\/span>. <a title=\"SOPA and PIPA :: Wikipedia\" href=\"http:\/\/en.wikipedia.org\/wiki\/Protests_against_SOPA_and_PIPA\" target=\"_blank\">The user-generated encyclopedia explains the history<\/a> leading up to these anti-piracy proposals, first intended to cut off resources for foreign Web sites hosting U.S. created content illegally but apparently drafted with language vague enough they <em>could<\/em> also be applied domestically. <a title=\"After Blackouts, What is Next for SOPA? :: Yahoo! News\" href=\"http:\/\/news.yahoo.com\/blackouts-whats-next-sopa-155000746.html\" target=\"_blank\"><span style=\"text-decoration: underline;\"><strong>Yahoo! News<\/strong><\/span> ruminates about the future<\/a> and asks, \u201cIs SOPA dead?\u201d The aforementioned Shirky provides the probable answer in the TED video:<\/p>\n<p style=\"text-align: left;\">\u201cIf we defeat these, as I hope we do, more is coming.\u201d <em>Joy<\/em>.<\/p>\n<p style=\"text-align: left;\">What exactly does this mean for our friends and neighbors who engage in media production and dissemination here in <strong>Champaign, Urbana<\/strong>, and the cities beyond? First, they had better not rely on the Kodak brand to be around forever, which simply pains us to type. Second, they had better purchase the most stable server or RAID drive they can afford so their grandchildren, let alone the world, can see their present work in the future. Third, they had better be wary of vintage material unquestionably produced outside the <strong>United States<\/strong> during most of the 20th century, even when used in \u201cderivative works\u201d or to illustrate critique and social commentary. Fourth, they had better file away proof of ownership for any material they post on-line. Certainly, this super-simplifies the latter situation \u2013 we\u2019re really not going to know <em>how<\/em> broadly a SOPA\/PIPA style tandem can be applied unless it is acted upon \u2013 but for those who honestly believe \u201cmaking a movie\u201d starts and ends with pointing a camera and recording \u2026 well, it gets complicated once you show it outside the family living room. Always does, always will.<\/p>\n<p style=\"text-align: left;\">As for <strong>C-U Blogfidential<\/strong> and <strong>MICRO-FILM<\/strong>, we\u2019re uncertain what ramifications could be in store for us. Taking music and videos out of the equation, since we have yet to actually <em>make<\/em> any ourselves, we feel relatively secure about what we\u2019ve incorporated in our reporting. Practically everything visual has been obtained from proper sources or self-created, the only text material we have reproduced has been press releases and a handful of book and newspaper excerpts <em>with permission<\/em> \u2013 that is <em>key<\/em> \u2013 while every streaming video appearing here or on our <strong>YouTube<\/strong> channel has been accessed from, once again, <em>proper sources<\/em> with a couple of potential exceptions we\u2019ll remove to keep the peace <em>if<\/em> we\u2019re asked nicely.<\/p>\n<p style=\"text-align: left;\">What happens if Johnny Law unceremoniously takes down a site, the owners of which are otherwise playing by the book, because one or two movie clips appearing on that site are deemed illegal? The site loses traffic, the owners lose revenue if they sport advertising or sell merchandise, the editors lose momentum in their writing and posting, and the whole enterprise possibly loses credibility even if they are proven innocent or have their functionality restored after the offending videos are removed, probably <em>all<\/em> on the owners\u2019 dime.
